The Golden Visa and ADGM

Worth being blunt, because "ADGM Golden Visa" appears in a lot of marketing and is not a thing.

The Golden Visa is a federal residence visa administered by the immigration authorities[ICP]. Setting up in ADGM does not confer eligibility, accelerate an application, or create a route that would not otherwise exist.

What an ADGM entity can do is form part of how someone qualifies — most obviously in the investor or entrepreneur categories, where a properly structured UAE business is relevant to the assessment. That is a genuine but modest role, and it is different from the claim that ADGM gets you one.

From the UAE government's own description[UAE Gov — Golden Visa]:

• Investors — 10 years for public investments; 5 years for real estate. Stated requirements include a minimum capital of AED 2 million, or owning property, or contributing to establishments paying at least AED 250,000 annually in taxes.
• Entrepreneurs — 5 years, requiring proof of an innovative project and documentation of project value.
• Exceptional talent — 10 years, covering doctors, scientists, inventors, creatives, executives, athletes, PhD holders and specialists in priority fields, each with specific requirements such as recommendation letters.
• Outstanding students — 5 years for high school achievers; 10 years for top university students, requiring certificates of excellence.
• Humanitarian pioneers and frontline heroes — 10 years, requiring certificates of appreciation, documentation of humanitarian contribution, or at least 5 years of service.

These are the categories and figures as the government states them. Eligibility is assessed case by case and the detailed criteria sit with the immigration authorities rather than with any free zone or adviser.

Worth pinning down, because a great deal of Golden Visa material online cites a repealed resolution.

The governing instrument is Cabinet Resolution No. 65 of 2022, in force since 3 October 2022[UAE — Cabinet Resolution 65 of 2022]. Article 77 provides simply that the provisions set out in the Annex attached to the resolution shall apply to the Golden Residence Permit[UAE — Cabinet Resolution 65 of 2022].

The repeal

Article 79 repeals, expressly[UAE — Cabinet Resolution 65 of 2022]:

• Minister of Interior Resolution No. 360 of 1997, the previous Executive Regulation; and
• Cabinet Resolution No. 8 of 2021 concerning the regulation of the Golden Residence Permits.

That second one matters. Cabinet Resolution No. 8 of 2021 was the Golden Visa regulation, and it is repealed. Any guide, provider page or checklist still citing it by number is working from an instrument that no longer has effect — which does not automatically make its content wrong, but does mean nobody has checked it since 2022.

It is the same pattern this site has found repeatedly in UAE and ADGM material: the substance is often broadly right, the citation is dead, and the reader has no way to tell which parts survived.

Where the detail actually lives, and why it is not reproduced here

Article 77 delegates the whole Golden Residence scheme to the Annex. The Annex is published as a separate document on the UAE Legislation portal, and we were not able to retrieve it as text — it is served as a download that resists automated access.

So we are not going to list categories and thresholds here. We could restate what circulates on advisory sites, but that is precisely the practice that keeps a repealed 2021 resolution alive in search results, and this site does not publish a figure it has not read in the source.

What to do instead: take the categories and thresholds from the Annex to Cabinet Resolution 65 of 2022 on the UAE Legislation portal, or from the government's own Golden Visa page[UAE Gov — Golden Visa], and confirm with the ICP[ICP] before relying on any figure. Three honest observations rather than a promise.

An operating company is a more useful fact than a shell. The investor and entrepreneur categories concern real economic activity. A structure with genuine substance is more legible to an assessor than one without.

An SPV is a poor fit. It cannot conduct operational business or hire staff[ADGM — SPVs]. A passive holding vehicle is not an obvious basis for an entrepreneur application, whatever it holds.

Ordinary residence is the more common route. Most people setting up in ADGM sponsor a normal residence visa through the company[UAE Gov — Residence visas] — see ADGM visas — and consider the Golden Visa separately, later, on its own merits.

If long-term residence is a primary objective, take immigration advice on the category before choosing a corporate structure to fit it. Doing it the other way round is how people end up with a vehicle that suits neither purpose.

Golden Visa criteria have been revised repeatedly since the scheme began, and the categories have expanded. A formation site quoting today's detail is publishing a snapshot that will be wrong within a year — and immigration is an area where acting on stale information costs real money.
